Legal analysis tools

One of the most difficult parts of the privacy policy development process is identifying the existing patchwork of laws and regulations that already govern the sharing of information across the criminal justice system. As part of Illinois's integrated justice effort, I helped develop several documents that, even though they focus on Illinois law, can assist justice agencies in other states. This is because the privacy issues surrounding the justice system's enhanced collection, analysis, and sharing of individuals' information are almost universal.

Both the Issues document and Privacy Policy Guidance highlight the privacy concerns that justice agencies should attempt to address as they connect their data systems. The CFR / FIP Analysis was originally developed as a technique to assess how Illinois has implemented the Fair Information Practices - something that every jurisdiction should understand even if they don't document the findings. Finally, since legislatures are continually responding to the public's concerns, it is important to monitor legislative proposals.
